Andrejic & Partners has advised Eyemaxx International Holding & Consulting, a member of the Eyemaxx Real Estate AG group, on its restructuring in Serbia.
According to Andrejic & Partners, the restructuring consisted of an entire change of management in Eyemaxx’s four Serbian entities, employee changes, and a change of the corporate seat of all four Serbian entities.
Andrejic & Partners’ team included Attorneys Aleksandar Andrejic and Dragana Rajkovic.

Attorney Aleksandar Andrejic gave an interview on national television of Serbia. During the interview, he stated that “reorganization can help companies in distress” and that “reorganization plan must be based on feasible grounds”.
Dalje, objasnio je da obezbeđeni poverioci obično naplaćuju većinu svojih potraživanja, dok neozbeđenim poveriocima često ostaju mali delovi stečajne mase za naplatu potraživanja.
Gospodin Andrejić je izjavio da kompanije u nekim slučajevima mogu nastaviti sa poslovanjem čak i tokom stečajnog postupka do datuma prodaje.

Dalje, objasnio je korake koje treba poduzeti kako bi se povrat novca naplatio od agencija u slučaju da klijenti odluče pokrenuti tužbu protiv agencija.

Nadalje, objasnio je proceduru otkazivanja već plaćenih putovanja i mogućnost refundacije. Dodao je da je moguće da agencije nisu dovoljno solventne da isplate refundacije.
“The agencies had little to no work during the last year and therefore they may not be able to pay the refund to its clients,” said Mr. Andrejic.

Attorney Aleksandar Andrejic was a guest on the news program – Telemaster where he commented on enforcement procedures in Serbia and public enforcement officers.
Objasnio je zakonska ograničenja kada je u pitanju obim izvršenja nad fizičkim licima. Dalje, advokat Aleksandar Andrejić dao je objašnjenje o korisnim koracima nakon što klijent dobije rešenje o izvršenju.
Takođe, advokat Andrejić je objasnio specifičnosti posebnih izvršnih postupaka.

“The purpose of public enforcement officers is to forcibly collect a claim that the debtor has not settled voluntarily. As far as limits of their authorization is concerned, they are certainly not authorized to break windows in order to enter the building. If the debtor does not cooperate, the enforcement officer must certainly not do that but should hire a locksmith. Another important note is that the enforcement officer does not perform physical coercion, but the police do. The enforcement officer have the right to forcibly evict the person, the police are present if it is reasonably expected that there will be opposition to the execution or if the execution was attempted earlier, and there was an obstruction of the debtor” said Andrejic.
