CEE LEGAL MATTERS: Andrejic & Partners Advises Eyemaxx Real Estate on EUR 10 Million Loan from Bank of China
Andrejic & Partners has advised German listed company Eyemaxx Real Estate AG on providing collaterals and giving security for a EUR 10 million loan from Bank of China’s Frankfurt branch.
Serbia-based properties were provided as collateral.
Eyemaxx Real Estate Group, which has been operating on the market for more than 20 years, focuses on the development of residential properties, micro and student apartments, hotels, and serviced apartments, and urban quarters, as well as retail and logistics properties. The Eyemaxx Real Estate Group holds selected real properties in its portfolio.

Andrejic & Partners have advised Eyemaxx International Holding & Consulting GmbH and Log Center doo Belgrade in a complex share and land purchase transaction where we provided assistance during a sale procedure of part of their Serbian assets.
CTP Invest is a privately held developer and manager of business parks in Central Europe.
Eyemaxx Real Estate is a developer of residential office properties, micro and student apartments, hotels and serviced apartments, urban quarters, as well as retail and logistics. The company’s core markets are Germany and Austria.
CEE LEGAL MATTERS: Andrejic & Partners Advises Eyemaxx International Holding & Consulting on Organizational Restructuring in Serbia
Andrejic & Partners has advised Eyemaxx International Holding & Consulting, a member of the Eyemaxx Real Estate AG group, on its restructuring in Serbia.
According to Andrejic & Partners, the restructuring consisted of an entire change of management in Eyemaxx’s four Serbian entities, employee changes, and a change of the corporate seat of all four Serbian entities.
Andrejic & Partners’ team included Attorneys Aleksandar Andrejic and Dragana Rajkovic.
Radio-television of Serbia: Attorney Aleksandar Andrejic said reorganization may help distressed companies
Attorney Aleksandar Andrejic gave an interview on national television of Serbia. During the interview, he stated that “reorganization can help companies in distress” and that “reorganization plan must be based on feasible grounds”.
Further, he explained that secured creditors usually recover most of their claims while unsecured creditors are often left with small portions of the bankruptcy estate.
Finally, Mr. Andrejic stated that the company can even continue to operate in the bankruptcy proceedings until the sale.

Attorney Aleksandar Andrejic appeared on national television and spoke about canceled vacations due to the covid-19 crisis. He explained possibilities on refund from the agencies and other options which clients have at their disposal.
Further, he explained the steps that should be undertaken in order to collect the refund from the agencies in case clients decide to initiate a lawsuit against the agencies.

Attorney Aleksandar Andrejic gave an interview for CNN-owned television N1. During the interview, he explained the possibilities to travel due to covid-19 restrictions.
Further, he explained the procedure of cancellation of already paid trip packages and refund. He added that it may be questionable whether the agency will be solvent to pay the refund.
“The agencies had little to no work during the last year and therefore they may not be able to pay the refund to its clients,” said Mr. Andrejic.

He explained the legal restrictions when it comes to the scope of enforcement against physical entities. Further, attorney Aleksandar Andrejic gave an explanation about adviseable steps after the client receives a decision on enforcement.
Finally, Mr. Andrejic elaborated on the specifics of different kinds of enforcement procedures.

Attorney Aleksandar Andrejic gave an interview for CNN-owned television N1. During the interview he commented about legal framework of enforcement proceeding.
“The purpose of public enforcement officers is to forcibly collect a claim that the debtor has not settled voluntarily. As far as limits of their authorization is concerned, they are certainly not authorized to break windows in order to enter the building. If the debtor does not cooperate, the enforcement officer must certainly not do that but should hire a locksmith. Another important note is that the enforcement officer does not perform physical coercion, but the police do. The enforcement officer have the right to forcibly evict the person, the police are present if it is reasonably expected that there will be opposition to the execution or if the execution was attempted earlier, and there was an obstruction of the debtor” said Andrejic.
